FFP waivers and deferrals
A deferral still
leaves work to do.
The result arrives. What changes now? Keep the request, response and remaining obligations beside the decision.
A limited result
ADR deferred.
Disclosure still open.
The Harbour example follows an ADR request through a limited deferral. The missing disclosure remains a separate issue.

The matter needs updating.
After a request, the team needs more than “resolved.” A waiver and a deferral have different consequences. The returned order controls what was granted, its conditions and the work still required.
The FFP Manual directs waiver or deferral requests through the Desk Process. Appendix B of the revised Notice sets out the request, notice, response and filing sequence. It gives the respondent five clear days to respond, with filing after that period or receipt of the response. The 10 August 2026 update requires copies of filed application materials to reach the respondent. The applicant must also serve the resulting order.
Start with the particular requirement and the facts counsel needs to assess. Keep unanswered questions visible before drafting. The Court’s forms hub provides the current request, desk application, notice and response forms.
The Harbour matter
The result changes
only what it addresses.
The respondent does not oppose the ADR deferral but raises incomplete disclosure. The returned result addresses ADR only. Both points stay with the matter.

Counsel’s note: assess an ADR deferral request. Gather the provider’s availability and the parties’ correspondence. Confirm the explanation with Alex before completing the forms.
Internal drafting instruction
ADR only
Prepare the request concerning ADR. Explain the proposed timing using the supporting correspondence. Leave the factual explanation for counsel and client confirmation.
Inspect the fictional response excerpt
The respondent does not oppose postponing ADR to the proposed date, but says financial disclosure remains incomplete.
Prepared review note
Response received
Add the response to the request record. Counsel must address the disclosure point and check the procedural record before directing the next step.

Deferral, limited to ADR
Carry the stated ADR date into counsel’s review. Keep the disclosure issue open. Confirm the complete order, its service and the further preparation it requires.
A draft request is illustrated. No deferral has been granted.

What changed?
What is still owed?
Does preparing the request change compliance?
No. Preparation, service, submission, filing and a granted result are distinct. Record the event supported by the actual source.
Can a deferral close every preparation issue?
Read the order’s scope. The fictional result concerns ADR only; it supplies no missing disclosure and establishes no overall MIT readiness.
